We, SAGE MANAGEMENT SERVICES, a proprietorship concern having its registered office at No. 1, Civil Aviation Colony, 100 Feet Road, Nanganallur, Chennai, Tamil Nadu 600 061, hereby provide elder care services under the brand name Dr. SN Elder Care Services (hereinafter referred to as the “Company” or “Dr. SN Elder Care”). The term “Company” shall, unless repugnant to the context, include its legal heirs, representatives, administrators, permitted successors, and assigns.

Introduction

Dr. SN Elder Care Services, a brand managed by Sage Management Services, is dedicated to delivering professional and compassionate elder care solutions. This document outlines the terms and conditions governing the use of our services and the use of our website and mobile application (collectively referred to as the “Platform”). Please read these Terms of Use carefully along with our Privacy Policy before availing any of our services.

By using our services or accessing the Platform, you agree to abide by all the terms outlined in this Agreement. If you do not accept these terms, you are advised not to use our services.

Changes to Terms

The Company may amend these Terms of Use from time to time, and such modifications will become effective upon posting on the Platform. Continued use of our services will constitute your acceptance of such changes.

Nature of Services

Dr. SN Elder Care Services acts as a facilitator, connecting Clients (individuals seeking elder care services) with professional Care Providers (trained and vetted personnel). The Company provides verified and trained caregivers to Clients after an interview and selection process. However, the actual care services are delivered by independent Care Providers, and the Company does not directly provide elder care services.

Limitation of Liability

You agree that the Company, its affiliates, employees, agents, and representatives (collectively, “Dr. SN Elder Care Parties”) shall not be liable for any damages or claims arising from your use of our services, including but not limited to personal injury, property damage, or other losses incurred while receiving services from Care Providers. In the event any liability is imposed by law, the Company’s total liability will not exceed the fees paid by you in the month preceding the incident.

Caregiver Conduct & Replacement Policy

The Company ensures that all Care Providers undergo background verification and basic training.
The Company is not liable for any misconduct, negligence, or unlawful acts committed by the Care Providers. Any such issues will be dealt with by appropriate legal authorities
A replacement Care Provider will be provided within 7 days in case of dissatisfaction or withdrawal of services by the Care Provider within the first two months.
All service-related communications, including additional expenses, must be routed through the assigned Care Manager.
Clients are advised not to engage in direct monetary transactions with Care Providers. The Company disclaims liability for any such transactions.

Disclaimer of Warranties

The services are provided on an “as is” basis without any warranties, express or implied. The Company does not guarantee uninterrupted availability, accuracy, or reliability of its services or Platform. While reasonable efforts are made to safeguard user data, the Company is not responsible for unauthorized access or misuse of personal information.

Indemnification

You agree to indemnify and hold harmless Dr. SN Elder Care Parties from any claims, losses, damages, or legal expenses arising from your use of our services, breach of these Terms, or violation of any applicable laws.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Any unauthorized use of your account must be immediately reported to the Company.

Third-Party Links

Our Platform may contain links to external websites. The Company is not responsible for the content, privacy policies, or practices of such third-party sites.

User Eligibility

Services are intended for individuals who are 18 years and older. By using our services, you confirm that you meet this age requirement and have the authority to enter this Agreemen

License & Usage Restrictions

The Company grants you a limited, non-exclusive, non-transferable right to use its Platform and services for personal use. You shall not resell, copy, or modify any content, nor engage in any activity that disrupts the service.

Payment Terms & Cancellation

Fees are due immediately upon booking a service and are non-refundable.
Members can cancel their monthly service plan anytime by contacting the Care Manager. Any pending charges will be settled at the time of cancellation.
Same-day visit cancellations will incur a fee as communicated by the Company.

Intellectual Property

All content, logos, designs, and trademarks on the Platform are the property of Sage Management Services and its managed brands. No user is permitted to use them without prior written consent.

Termination of Services

The Company may suspend or terminate your access to its services at its sole discretion for violations of these terms or for any unlawful or inappropriate behavior.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

Severability

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force.

Entire Agreement

This Agreement constitutes the complete understanding between you and the Company concerning the use of our services and supersedes any prior agreements.
